Terms of Service

Last updated: 22 September 2026

These Terms of Service (“Terms”) govern access to and use of Trigora’s websites, Trigora Cloud, APIs, documentation, demos, and related services.

These Terms form a binding agreement between you and Trigora, Inc. (“Trigora,” “we,” “us,” or “our”).

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and references to “you” include that organization.

1. The Services

Trigora provides infrastructure for durable execution of long-running programs.

Our services include:

  • trigora.dev;
  • Trigora Cloud at cloud.trigora.dev;
  • Trigora APIs;
  • documentation and research;
  • the TCC Recovery Lab at demo.trigora.dev; and
  • related services that reference these Terms.

Trigora Cloud provides managed infrastructure for deploying Programs and operating Executions.

Features, limits, and availability may differ by plan.

2. Eligibility and accounts

You must be legally capable of entering into these Terms.

You must provide accurate account information and keep it current.

You are responsible for:

  • maintaining the confidentiality of your account credentials and API tokens;
  • activity performed using your account;
  • promptly notifying us of suspected unauthorized access; and
  • ensuring that users you authorize comply with these Terms.

You may not share credentials in a manner that circumvents account or plan limits.

3. Customer Content

“Customer Content” means code, data, inputs, outputs, event payloads, effect results, configuration, and other material that you submit to or generate through the Services.

As between you and Trigora, you retain ownership of your Customer Content. Trigora does not acquire ownership of your Program source code or artifacts.

Trigora maintains reasonable technical and organizational measures designed to protect the Services and Customer Content, including access controls, infrastructure encryption, and tenant isolation. See Security.

You grant Trigora a limited, non-exclusive, worldwide license to host, copy, transmit, process, modify, and otherwise use Customer Content solely as necessary to:

  • provide and operate the Services;
  • secure and troubleshoot the Services;
  • comply with your instructions;
  • enforce these Terms; and
  • comply with applicable law.

This license ends when the relevant Customer Content is deleted from our systems, subject to reasonable backup, security, and legal-retention periods.

You represent that you have all rights necessary to submit Customer Content to the Services.

4. Your responsibilities

You are responsible for your Programs, Executions, Customer Content, and use of external systems.

You are responsible for determining whether Trigora is appropriate for your workload and for implementing any safeguards required by your application.

Unless separately agreed in writing, the Services are not intended to serve as the sole control mechanism for applications where failure could reasonably result in death, serious bodily injury, or catastrophic physical damage.

You are responsible for securing credentials, secrets, API keys, and external systems used by your Programs.

5. Acceptable use

You may not use the Services to:

  • violate applicable law;
  • infringe or misappropriate another person’s rights;
  • distribute malware or intentionally harmful code;
  • gain unauthorized access to systems or accounts;
  • interfere with or disrupt the Services;
  • circumvent usage, billing, security, or access controls;
  • probe or test vulnerabilities without authorization;
  • use the Services to facilitate abusive, fraudulent, or deceptive activity; or
  • impose unreasonable load on shared infrastructure.

We may apply technical limits to protect security, reliability, and other users.

6. Cloud plans, billing, and usage

Some Trigora Cloud features are free and others require payment.

Current pricing, included usage, and metering rates are described on our Pricing page or in an applicable order form.

Free

Free usage is subject to limits and included usage credits.

When Free included usage is exhausted, we may pause or prevent additional execution activity until the allowance renews or the account upgrades.

Pro

Pro requires the monthly amount shown on the Pricing page.

The monthly Pro charge includes the amount of Cloud usage credit stated on the Pricing page. Usage beyond the included credit is billed at the then-current pay-as-you-go rates.

Enterprise

Enterprise pricing, limits, support commitments, SLAs, billing arrangements, and other terms may be specified in an order form or separate agreement.

Metering

Trigora may meter Cloud usage based on dimensions such as:

  • execution compute;
  • logical durable operations; and
  • durable storage.

Suspended or waiting wall-clock time is not billed merely because an Execution remains suspended.

We may update rates prospectively. Changes will not retroactively alter charges already incurred.

Payments

You authorize us and our payment provider to charge applicable fees to your selected payment method.

Fees are exclusive of applicable taxes unless stated otherwise.

Except where required by law or expressly stated otherwise, fees are non-refundable.

If payment is overdue, we may limit or suspend paid functionality after reasonable notice.

7. Usage credits

Credits:

  • have no cash value;
  • cannot be transferred unless we agree otherwise;
  • may only be used toward eligible Trigora Cloud usage;
  • may expire according to the plan or promotion under which they were issued; and
  • are not redeemable for cash.

Promotional credits may have additional terms.

8. Trigora Cloud availability

We work to provide a reliable service, but unless an Enterprise agreement states otherwise:

  • we do not guarantee uninterrupted availability;
  • we do not provide a contractual uptime SLA;
  • maintenance, outages, security events, or third-party failures may affect availability; and
  • we may change or discontinue features where reasonably necessary.

We will use reasonable efforts to avoid materially disrupting paid customers without notice where practicable.

9. Durable execution semantics

Trigora is designed to provide durable execution, but no distributed system can eliminate all failure modes.

Unless specifically documented or agreed otherwise:

  • Trigora does not guarantee exactly-once behavior for external systems that do not support appropriate idempotency or reconciliation;
  • benchmark results do not guarantee identical performance for your workloads;
  • recovery latency depends on workload, state, infrastructure, and other conditions; and
  • research or demonstration environments are not production SLAs.

10. TCC Engine and open or source-available software

The TCC Engine and other software that Trigora makes available through source repositories or package registries may be governed by separate license terms.

Those separate licenses, including any Business Source License or open-source license included with the software, govern your rights to copy, modify, distribute, or self-host that software.

These Terms do not expand or override rights granted under a separate software license.

Production self-hosting of TCC Engine may require a separate commercial license depending on the applicable software-license terms.

11. Self-hosted commercial licenses

Trigora may offer commercial licenses for production deployment of TCC Engine in customer-managed infrastructure.

Commercial self-hosting rights, support, maintenance, permitted deployment scope, and other terms are governed by the applicable commercial agreement.

Access to public source code or development/evaluation rights does not by itself grant commercial production rights beyond those provided by the applicable software license.

12. Intellectual property

Except for Customer Content and material expressly licensed under separate terms, Trigora and its licensors retain all rights in:

  • the Services;
  • Trigora trademarks and branding;
  • service software;
  • documentation;
  • research;
  • designs; and
  • related technology.

No rights are granted except as expressly stated in these Terms or another applicable license.

13. Feedback

If you voluntarily provide suggestions, ideas, or feedback regarding Trigora, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without restriction or compensation.

This does not grant us rights to your Customer Content.

14. Third-party services

The Services may integrate with or depend on third-party services.

Your use of those services may be governed by separate terms and privacy policies.

Trigora is not responsible for third-party services outside our control.

15. Privacy

Our Privacy Policy explains how we collect and process personal information.

When Trigora processes personal information contained in Customer Content on behalf of a business customer, additional data-processing terms may apply.

16. Suspension

We may suspend or restrict access to the Services where reasonably necessary because of:

  • violation of these Terms;
  • security risk;
  • fraud or abuse;
  • unpaid fees;
  • legal requirements; or
  • activity that threatens the Services or other users.

Where reasonably practicable, we will provide notice and an opportunity to resolve the issue.

17. Termination

You may stop using the Services at any time.

You may cancel a paid subscription through the available account controls or by contacting us.

Cancellation generally takes effect at the end of the applicable billing period unless stated otherwise.

We may terminate an account for material breach of these Terms or where continuing to provide the Services would create material legal or security risk.

After termination, access to Customer Content may cease.

You are responsible for exporting information you need before termination. We may delete Customer Content after a reasonable retention period unless law requires otherwise.

Sections that by their nature should survive termination will survive, including provisions concerning ownership, payment obligations, disclaimers, liability, indemnification, and governing law.

18. Confidentiality

If we receive non-public information from you that is clearly confidential or reasonably should be understood to be confidential, we will use reasonable care to protect it and will use it only in connection with providing the Services or our business relationship.

This provision does not apply to information that:

  • is publicly available through no breach of obligation;
  • was already lawfully known to us;
  • is independently developed without use of the confidential information; or
  • is lawfully received from another source without confidentiality restrictions.

Separate confidentiality agreements may apply to Enterprise relationships.

19. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, SOFTWARE, DOCUMENTATION, RESEARCH, AND DEMONSTRATIONS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TRIGORA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

20. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIGORA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOST PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITIES; OR
  • LOSS OR CORRUPTION OF DATA,

ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIGORA’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNTS YOU PAID TO TRIGORA FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR
  2. US $100.

The limitations in this section do not apply where prohibited by law.

21. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Trigora and its affiliates, officers, employees, and agents from third-party claims, liabilities, damages, and reasonable expenses arising from:

  • your Customer Content;
  • your Programs or use of external systems;
  • your violation of these Terms;
  • your violation of law; or
  • your infringement of another person’s rights.

We will provide reasonable notice of an indemnified claim and permit you to control the defense, subject to our right to participate with counsel at our own expense.

22. Changes to the Services or Terms

We may update the Services and these Terms as Trigora develops.

If we make a material change to these Terms, we will provide notice appropriate to the circumstances.

Changes apply prospectively from their stated effective date.

Continued use after the effective date constitutes acceptance where permitted by law.

23. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and each party consents to their jurisdiction.

24. General

These Terms and any applicable order form or separate agreement constitute the entire agreement concerning the Services they govern.

If there is a conflict, a signed Enterprise order form or negotiated agreement controls over these Terms for the subject matter it addresses.

Failure to enforce a provision is not a waiver.

If any provision is unenforceable, the remaining provisions remain in effect.

You may not assign these Terms without our consent, except where applicable law provides otherwise. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of substantially all relevant assets.

Neither party is liable for delay or failure caused by circumstances beyond its reasonable control, except payment obligations.
